Terms & Conditions
These terms set out the basis on which Jelita provides residential placement and tenancy coordination services. Please read them carefully before engaging our services.
1. Definitions
In these Terms and Conditions, the following definitions apply:
- "Jelita" / "We" / "Us" — refers to Jelita, a residential placement and tenancy coordination service based at Jalan Maarof, Bangsar, 59000 Kuala Lumpur.
- "Client" / "You" — any individual or entity that engages Jelita's services or uses this website.
- "Services" — the residential placement, lease coordination, and related services described on this website.
- "Agreement" — these Terms and Conditions together with any service engagement letter or written confirmation.
- "Website" — the website located at jelitam.site and all pages and content therein.
2. Acceptance of Terms
By submitting an enquiry, entering into a service engagement, or using this website, you confirm that you have read and accept these Terms and Conditions in full.
Our services are available to individuals aged 18 and above who have the legal capacity to enter into a binding agreement. By engaging with Jelita, you confirm that you meet this requirement.
3. Services
Jelita provides the following residential placement and coordination services in the Bangsar area of Kuala Lumpur:
- Bangsar Village Residence Search (RM 2,580) — a focused search and pre-visit service for residential properties in the Jalan Maarof and Lucky Garden area.
- Lease Coordination & Tenancy Support (RM 6,400) — management of the formal tenancy process from owner verification through move-in and on to term renewal.
- Signature Bangsar Residence Programme (RM 10,400) — a relationship-led placement service for clients seeking the upper tier of Bangsar's residential rental market, including private viewings, building dossiers, and continuing concierge support.
Services are provided within Peninsular Malaysia, with primary focus on the Bangsar locality of Kuala Lumpur. Geographic restrictions may apply for certain service components.
4. Client Responsibilities
As a client, you agree to:
- Provide accurate, complete, and current information when requested.
- Attend or confirm viewings within agreed timeframes and provide reasonable notice if plans change.
- Not to approach property owners directly in a manner that circumvents the service agreement.
- Pay fees in accordance with the agreed payment terms.
- Use our website and services only for lawful purposes and in a manner consistent with these Terms.
You agree not to use the website to transmit spam, distribute harmful software, or engage in any activity that disrupts or damages our services or the experience of other users.
5. Intellectual Property
All content on this website — including text, design, service descriptions, photography, and branding — is the property of Jelita or used under licence. You are granted a limited, non-exclusive, non-transferable right to view and use this website for personal, non-commercial purposes.
You may not reproduce, distribute, publish, or commercially exploit any content from this website without prior written permission from Jelita. Building dossiers and residence reports produced by Jelita during service delivery are for the personal use of the commissioning client only.
6. Payment Terms
Service fees are as stated on our Solutions page and in any written engagement confirmation. All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.
Payment terms, instalment schedules (where applicable), and accepted payment methods will be confirmed in writing at the commencement of each engagement. Fees are generally payable prior to or upon commencement of the relevant service stage.
REFUND POLICY
Fees paid for the Bangsar Village Residence Search are refundable if no qualifying properties have been presented within 30 days of engagement commencement. For Lease Coordination and Signature Programme services, refunds on work completed are not available; partial refunds for work not yet commenced may be considered at Jelita's discretion. Refund requests should be submitted in writing to [email protected].
7. Service-Specific Terms
Residence Search
The search service covers properties in the agreed geographical scope. Jelita will pre-visit candidate properties and provide honest impressions of condition and character before arranging viewings. The client's decision to proceed with any property remains entirely their own.
Lease Coordination
Jelita facilitates the tenancy process and acts as a point of contact between resident and owner. We do not act as a principal to any tenancy agreement and bear no liability for the terms agreed between resident and owner. All tenancy agreements should be reviewed by the client before signing.
Signature Programme
Concierge and household support introductions are provided as a courtesy and convenience. Jelita does not warrant the quality or reliability of third-party service providers introduced as part of this programme. Clients should conduct their own due diligence before engaging any recommended third party.
8. Disclaimers
Our services and this website are provided on an "as available" basis. While we take care to present accurate information, we make no representations as to the completeness, accuracy, or suitability of any information for a particular purpose.
Jelita does not represent or advise on the legal, financial, or investment aspects of any property. Clients requiring such advice should engage suitably qualified professionals. Property conditions and market circumstances may change; any information we provide reflects our observations at the time of assessment.
9. Limitation of Liability
To the extent permitted under Malaysian law, Jelita's total liability to you in connection with any engagement shall not exceed the fee paid by you for the relevant service.
We shall not be liable for indirect, consequential, or special losses, including loss of rental opportunity, damage caused by third parties introduced during the service, or losses arising from reliance on information provided in good faith but subsequently found to be inaccurate.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify Jelita against any claims, damages, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of our website or services, or any false or misleading information you have provided to us.
11. Termination
Either party may terminate a service engagement by providing written notice. Where Jelita terminates due to a client's material breach of these Terms, fees paid for work completed will not be refunded.
Where a client terminates an engagement, the refund position set out in Section 6 applies. Upon termination, the provisions of Sections 5, 9, 10, and 12 of these Terms shall continue to apply.
12. Dispute Resolution
These Terms and any disputes arising from them are governed by the laws of Malaysia. Both parties agree to submit to the non-exclusive jurisdiction of the Malaysian courts.
In the event of a dispute, we encourage both parties to first attempt to resolve the matter informally by written communication. If informal resolution is not reached within 30 days, either party may refer the matter to mediation through the Kuala Lumpur Regional Centre for Arbitration (KLRCA) or pursue formal legal proceedings.
13. General Provisions
Entire Agreement. These Terms, together with any written service confirmation, constitute the entire agreement between the parties and supersede all prior discussions or representations.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
Waiver. Failure by either party to enforce any provision shall not constitute a waiver of the right to enforce it at a later date.
Assignment. You may not assign or transfer your rights under any service engagement without Jelita's prior written consent.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page, marked with the effective date above. Continued use of our services after a change has been posted constitutes your acceptance of the updated Terms. For active service engagements, material changes will be communicated by email.
